Acceptance of these terms
These Terms of Service ("Terms") are an agreement between you and Harmony Stack ("Harmony Stack", "we", "us"), the developer of the CDL One Stop mobile application (the "App").
By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App and delete it from your device.
If you are under 13 years old, you may not use the App. If you are between 13 and the age of majority where you live, you may use the App only with the involvement of a parent or legal guardian who agrees to these Terms.
What CDL One Stop is
CDL One Stop is a commercial driver's license study app. It provides practice questions, explanations, pre-trip inspection material, reference articles, progress tracking, readiness scoring, streaks, achievements, and study reminders covering all 50 states and the District of Columbia across Class A, B, and C.
We work to keep the study material accurate and current, but rules, question banks, fees, and testing procedures change and vary by state. We do not warrant that every item in the App matches your state's current exam.
Study aid — not official or legal advice
The App is an independent study tool. It is not affiliated with, endorsed by, or sponsored by the Federal Motor Carrier Safety Administration (FMCSA), any state Department of Motor Vehicles or licensing agency, any testing vendor, or any employer.
Practice questions in the App are not actual exam questions, and passing practice in the App does not guarantee that you will pass any official CDL knowledge test, skills test, or medical or endorsement requirement.
Always verify with the official source. Your state's CDL handbook and licensing agency are the authority on what is tested and what is required. Nothing in the App is legal, medical, employment, or safety-compliance advice.
Never rely on the App while operating a vehicle. Use it only when it is safe and legal to do so.
Your license to use the app
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices you own or control, for your own non-commercial study.
Your use is also governed by Apple's Licensed Application End User License Agreement. Where these Terms and Apple's standard EULA conflict, these Terms control as between you and Harmony Stack, except where Apple's terms are required to control.
We reserve all rights not expressly granted to you.
Purchases, pricing, and refunds
CDL One Stop is sold as a one-time purchase through the Apple App Store. There is no subscription and no recurring charge.
- Apple processes the payment, issues the receipt, and applies the price shown in your storefront, including any tax.
- Refunds are handled by Apple, not by us. Request one at reportaproblem.apple.com. We can't issue, approve, or reverse App Store refunds.
- Your purchase is tied to your Apple Account and can be restored on your devices through the App Store.
- We may change the price or the packaging of the App at any time. Changes are not retroactive to purchases already made.
Accounts and sign-in
You can use most of the App without an account. If you choose to sign in — with Sign in with Apple, with an email address, or as a guest — you agree to provide accurate information and to keep your credentials secure. You are responsible for activity that happens under your account.
Signing in lets us sync progress across your devices and support features such as leaderboards and achievements. You may ask us to delete your account and associated cloud data at any time by emailing harmonyStack@gmail.com.
We may suspend or close an account that is used to break these Terms, to abuse other users, or to interfere with the App.
Acceptable use
You agree not to:
- Copy, scrape, export, resell, sublicense, or republish the App's questions, explanations, illustrations, or other study content;
- Use the App or its content to build, train, or supply a competing product, question bank, or dataset;
- Reverse engineer, decompile, or attempt to extract the App's source code or content files, except where that restriction is prohibited by law;
- Interfere with, overload, or attempt to gain unauthorized access to the App, our servers, or another user's account;
- Falsify scores, streaks, achievements, or leaderboard standings, or use automated tools to do so;
- Use the App for any unlawful purpose, or to misrepresent your qualifications to an employer or licensing agency.
Our content and your feedback
The App, its design, text, illustrations, audio, question banks, explanations, and the CDL One Stop and Harmony Stack names and logos are owned by Harmony Stack or its licensors and are protected by copyright, trademark, and other laws. Underlying regulatory material sourced from public government publications remains in the public domain; our selection, wording, arrangement, and explanations do not.
If you send us feedback, bug reports, corrections, or feature ideas, you grant us a perpetual, worldwide, royalty-free license to use them to improve the App, without obligation or compensation to you. Please don't send us anything you consider confidential.
Apple, Game Center, and other services
These Terms are between you and Harmony Stack only — not with Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
The App uses third-party services to work, including Apple services (App Store, Sign in with Apple, Game Center, push notifications) and our hosting and authentication provider for accounts and sync. Their own terms apply to their services, and features that depend on them may be unavailable if those services are.
Links to state licensing agencies and other outside sites are provided for convenience. We don't control that content and aren't responsible for it.
Privacy
We don't sell your personal information and we don't use third-party tracking or advertising in the App. Your study progress — streaks, levels, key dates, and missed questions — is kept on your device unless you sign in to sync it.
Our Privacy Policy explains exactly what the App keeps on your device, the little an optional account stores, how calendar and notification permissions are used, and how to have anything deleted. It is part of these Terms.
If you email us for support, we use your message only to help you and reply. Any privacy question can go to harmonyStack@gmail.com.
Availability and changes to the app
We may update, change, or remove features, question banks, and study content; require a supported iOS version; or stop offering or supporting the App entirely. We'll try to avoid surprises for anyone actively studying, but we don't guarantee that any particular feature or piece of content will remain available.
The App may be unavailable during maintenance, outages, or events outside our control.
Disclaimer of warranties
The App and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law.
We do not warrant that the App will be uninterrupted, error-free, or secure; that its content is complete, current, or matches your state's exam; or that using it will result in passing any test or obtaining any license, permit, endorsement, or job.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Harmony Stack will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost opportunities, failed exams, testing or licensing fees, or lost wages, arising out of or relating to your use of the App — even if we've been advised such damages are possible.
Our total liability for all claims relating to the App is limited to the greater of the amount you paid for the App in the twelve months before the claim, or ten U.S. dollars ($10).
Some jurisdictions do not allow limits on incidental or consequential damages, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.
Termination
You may end this agreement at any time by deleting the App from your devices. We may suspend or terminate your license and any account if you break these Terms or use the App in a way that harms other users or us.
Sections that by their nature should survive — content ownership, acceptable use, disclaimers, limitation of liability, and governing law — survive termination.
Changes to these terms
We may update these Terms as the App evolves or as the law requires. When we do, we'll change the effective date at the top of this page and post the updated Terms here. Material changes will also be noted in the App or in a release note where practical.
Continuing to use the App after an update means you accept the revised Terms.
Governing law and disputes
These Terms are governed by the laws of the United States and of the state in which Harmony Stack is based, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
You and Harmony Stack agree to try to resolve any dispute informally first — email us and give us 30 days to work it out. Any dispute that can't be resolved that way will be brought in the state or federal courts located where Harmony Stack is based, and you and Harmony Stack consent to the jurisdiction of those courts. Either party may still seek relief in small-claims court where eligible.
Claims must be brought individually, not as a class or representative action. If any part of these Terms is found unenforceable, the rest stays in effect.
